Trademark Search in Vietnam: How to Check a Brand Before Filing

Before applying for a trademark in Vietnam, search Vietnamese trademark records and check relevant international records. Look beyond exact matches: compare similar words or logos, the goods and services involved, and the status of each result. A preliminary trademark search can reveal potential conflicts, but a clear result does not guarantee that the application will be accepted.

Why Conduct a Trademark Search in Vietnam Before Filing?

A trademark search helps a business identify earlier marks that may affect its proposed brand. Finding a potential conflict before investing in packaging, a Vietnamese website, or a launch campaign gives the business time to assess its options.

A company name availability check answers a different question. It concerns whether a proposed legal business name can be registered. A trademark search examines signs used to identify goods or services. Registering a company name does not, by itself, establish that a similar brand can be registered as a trademark for the company’s products. See VINEX’s guide to registering a business name in Vietnam for the company-name side of that process.

A preliminary trademark search shows records available through the tools and search terms used. It does not decide whether the proposed mark is distinctive, whether two marks are confusingly similar, or whether every relevant earlier application is visible at the time of the search.

Where Can You Search for Trademarks in Vietnam?

Tool

What to check

Main limitation

Vietnamese trademark records, similar names, listed goods or services, owner, and recorded status

Results depend on the query and available database records; they do not determine registrability

Relevant international records and participating national or regional collections

Its coverage does not replace a search of Vietnamese trademark records

Start with the proposed brand name in IPPlatform, then open potentially relevant records. A result may concern an application rather than a registered trademark. Check its number, owner, goods or services, and status before drawing a conclusion.

WIPO’s database supports searches by names, numbers, goods and services, and image similarity. For a Vietnam market entry, examine whether an international record is relevant to Vietnam. Do not assume that every mark visible in a global search has protection in Vietnam.

How to Perform a Preliminary Vietnam Trademark Search

1. Prepare the mark and goods or services

Write down the exact word mark you want to use. If it includes a logo, keep a clear image and identify its prominent words and visual elements. List what the business will actually sell or provide in Vietnam.

Identify likely trademark classes, but consider related goods or services beyond a single class number. The commercial relationship between them can matter when assessing a similar mark.

2. Search the exact name and reasonable variants

Search the exact brand name first. Then try variations in spacing, spelling, and pronunciation. Search a prominent word separately if the mark contains several words. For a logo, search its word elements and inspect visually similar results where the tool permits.

3. Review close results in context

For each close result, compare the marks and the listed goods or services. Check whether the record concerns an application, an active registration, or another status requiring closer review.

A result in a different class is not automatically irrelevant. A shared word does not automatically mean the new mark cannot be filed, either.

4. Keep a search record

Save the search date, terms used, application or registration numbers, owners, goods or services, and recorded statuses. These details make it easier to seek a fuller assessment and document the eventual brand decision.

How Should You Interpret Trademark Search Results?

An exact match for the same or closely related goods or services calls for careful review. Similar spelling, sound, appearance, or meaning can also matter. A result for apparently unrelated goods may present a different risk, but it should not be dismissed solely because its class number differs.

Hypothetical example: A Singapore skincare business plans to use “LUMERA” in Vietnam. Its exact-name search finds nothing, but a wider search returns “LUMIRA” in a record concerning skincare products. That result does not prove that “LUMERA” will be refused. It shows why an exact-match search is an insufficient basis for approving the brand.

A search may miss records because of the query used, the information available in a database, or the timing of publication and updates. Other registrability issues may arise even when no close earlier mark appears.

What Should You Do After the Trademark Search?

  • No apparent conflict: Arrange a fuller registrability review. Confirm the proposed mark, applicant, and goods or services before filing.

  • Potential conflict: Record the earlier mark’s details and ask an IP professional to assess its similarity, status, and the available options.

  • New products or services later: Revisit whether the business’s trademark plans still cover what it actually offers.

Keep the findings with the brand decision. For related issues after entering the market, see VINEX’s Vietnam IP Compliance 2026 guide. The filing procedure itself can be covered in a separate trademark registration article.

Frequently Asked Questions

Is a trademark search mandatory before filing in Vietnam?

A preliminary database search is a recommended preparation step, rather than a guarantee or a substitute for the official examination of an application. It helps identify potential issues before spending money on filing and launch materials.

Can I rely only on the WIPO Global Brand Database?

No. WIPO recommends checking national or regional registers as well. For a brand intended for Vietnam, search Vietnamese records and review relevant international records rather than relying on one database.

Is registering a company name the same as protecting a trademark?

No. A company name identifies the legal entity, while a trademark identifies goods or services. Check both questions if the company name will also be the customer-facing brand.

Does a clear search result guarantee approval?

No. The result depends on available records and how the search was performed. The competent authority will examine the application under the applicable trademark rules, including issues an exact-name search may not resolve.

How VINEX Can Support Your Brand Review

VINEX can help foreign businesses place a proposed brand review within their broader Vietnam market-entry and compliance plans. If a search identifies a potentially conflicting mark or raises a registrability question, obtain an assessment from an appropriately qualified IP professional before filing.

To prepare for that review, provide the proposed name or logo, the goods or services planned for Vietnam, the intended launch date, and any search results already found.
