Trademark Registration in Vietnam: A Filing Guide for Foreign Businesses

A foreign business can apply to register a trademark in Vietnam without first establishing a Vietnamese company. It must choose the appropriate applicant and filing route, and may need to act through an authorised industrial property representative in Vietnam. The process is check the mark → choose goods and services → prepare and file → examination → decision. A trademark already registered in Hong Kong does not automatically receive protection in Vietnam.
What Does Trademark Registration Protect in Vietnam?
A trademark identifies the goods or services of one business and distinguishes them from those of others. A business may seek protection for a brand name, logo, or combination of elements, subject to the applicable requirements. The application identifies both the mark and the goods or services for which protection is requested.
A registered company name identifies a legal entity. Approval of that name does not, by itself, mean it is available or protected as a trademark. If the company name will also appear on products, a website, or storefronts, check both questions. VINEX explains the company-name side in How to Register Your Business Name in Vietnam.
Trademark planning should begin before the brand appears on packaging or in distributor agreements. Filing an application does not guarantee registration.
Who Can Apply for a Trademark in Vietnam?
Vietnamese and foreign organisations or individuals can seek registration if they meet the applicable rules on the right to register. A Hong Kong company may be the applicant before it incorporates a Vietnam subsidiary.
Choose the owner deliberately. If the Hong Kong parent controls the brand across markets, it may wish to hold the Vietnam application. If a subsidiary will be the applicant, document why and consider future licensing, restructuring, or transfer. Do not let a distributor or service provider file in its own name without a clear ownership agreement.
Does a foreign applicant need a local representative?
For a national application, a foreign organisation without a production or business establishment in Vietnam generally needs an authorised industrial property representative. Confirm the applicant’s circumstances and the representative’s authority before preparing a power of attorney.
An adviser who coordinates documents is not necessarily the entity authorised to represent the applicant before Vietnam’s IP Office. Confirm who will formally file and manage the application.
National filing or the Madrid System?
Route | When to examine it | Key point for a Hong Kong business |
National application in Vietnam | When seeking protection directly through Vietnam’s filing procedure | Check whether the foreign applicant must use an authorised local representative |
Madrid System designation of Vietnam | When the applicant meets Madrid eligibility requirements through a member and has a qualifying basic application or registration | A Hong Kong trademark registration alone should not be assumed to provide this route |
The Madrid Protocol has not been applied to Hong Kong in the same way it applies to Madrid System members. A Hong Kong business may qualify through a genuine connection to another member, but its eligibility and basic mark must be checked. A designation of Vietnam remains subject to Vietnam’s trademark examination. Review Vietnam’s IP Office guidance and WIPO’s Madrid membership and eligibility guidance when selecting the route.
What Should You Check Before Filing?
The mark: Search for identical and confusingly similar marks. Review relevant records, their status, and their goods or services. A clear preliminary search is not an approval.
The owner: Name the entity intended to hold the Vietnam rights. Check the choice against group ownership, licensing, and distribution plans.
The filing scope: List the goods and services the business offers or genuinely plans to offer. Check the relevant classification without copying an unsuitable list from another application.

What Documents and Information Are Needed?
Prepare for a standard filing | Check whether your case also requires |
Applicant details, a clear representation of the mark, and a classified list of goods and services | A power of attorney, evidence of a transferred right to apply, priority documents, or materials required for a special type of mark |
Use the current application form and confirm language, supporting-document, and fee requirements. VINEX should check the final dossier against Vietnam’s IP Office trademark application guidance before filing. A checklist copied from an older article may refer to an outdated form.
How Does the Trademark Registration Process Work?
Stage | What happens | Applicant’s task |
Prepare | Select the owner, mark, and goods or services | Make sure they match the commercial plan |
Search | Review potentially conflicting marks | Investigate close results before filing |
File | Submit the application through the applicable route | Keep proof of filing and the application number |
Formality and publication | The IP Office checks formal requirements; a valid application moves to publication | Track status and official communications |
Examination and responses | The mark is assessed; notices or third-party objections may arise | Respond within the applicable deadline |
Decision and management | The authority decides the application | Maintain the registration and monitor later changes |
Assign a person or representative to monitor the file throughout. A successful submission does not mean the mark has already been registered.

How Long Does Trademark Registration Take in Vietnam?
Statutory periods and total completion time are different. Under changes effective in 2026, the statutory period for substantive examination is five months from publication for trademark applications covered by the new rule. Publication has a separate statutory period after an application is considered valid. Certain qualifying cases may request faster substantive examination.
Those periods are not a guaranteed filing-to-registration timeline. Preparation, formality examination, corrections, objections, notices, and the final decision can affect the actual completion date. Request a stage-by-stage estimate for the particular mark and route.
What Affects the Cost of Trademark Registration?
Separate the following in a quote:
Official charges: filing and other applicable charges, which can vary with the application and goods or services covered.
Representative or advisory fees: preparation, filing management, and agreed advice.
Additional work: searches, translations, supporting documents, or responses to notices and objections.
Check whether the quote covers only initial filing or also examination responses, registration-stage steps, and later monitoring. Avoid treating one advertised price as the total cost for every case.
Common Filing Mistakes Foreign Businesses Should Avoid
A company-name approval does not clear a trademark. Filing under the wrong group entity can complicate future licensing or restructuring. An incomplete goods and services list may omit an important product line. A preliminary search cannot guarantee registration.
The final risk is losing track of the application after filing. Agree who receives official notices, who decides how to respond, and who monitors deadlines.
VINEX’s view: Settle who should own the mark before completing the form. For a Hong Kong group entering Vietnam, this decision affects future distributor arrangements, licensing, and changes to the local company structure.
Frequently Asked Questions
Can I register a trademark before setting up a company in Vietnam?
Yes. A foreign business may apply without first incorporating a Vietnam company. Confirm the applicant, filing route, and representation requirements.
Do I need a local representative?
A foreign organisation without a production or business establishment in Vietnam generally needs an authorised industrial property representative for a national filing. Check the applicant’s actual circumstances before appointing one.
Is a Hong Kong trademark automatically protected in Vietnam?
No. A Hong Kong registration does not automatically extend protection to Vietnam. The owner must assess a suitable route to seek protection there.
Can I register a word mark and a logo separately?
A business can consider separate applications for different versions of its mark. Choose based on the elements it uses and wants protected, and account for the additional filing cost.
What happens if a similar mark is already registered?
Review its status, owner, goods or services, and similarity to the proposed mark. Obtain a qualified assessment before filing or investing further in the brand.
